Terms & Conditions
Terms & Conditions
A clear guide to ordering, payments, measurements, production, customisation, shipping, returns, refunds, cancellations and client responsibilities.
MINIEKUT FASHION HOUSE • NIGERIABy placing an order, making a payment, booking a consultation, or otherwise proceeding with a Miniekut service, you acknowledge that you have read, understood and agreed to the applicable terms in this document, subject always to any rights that cannot lawfully be excluded under applicable law.
01 Introduction & Purpose
Miniekut Fashion House ("Miniekut", "we", "us" or "our") creates bespoke, made-to-order and, where applicable, ready-made fashion pieces. Because our garments may involve individual measurements, custom fabrics, colour selections, embellishment, design adjustments and dedicated production time, each order requires clear communication between Miniekut and the client ("you" or "the client").
These Terms & Conditions and Brand Policy Agreement set out the rules that apply to purchases made through our website, social channels, direct client communication, consultations and other approved Miniekut ordering channels.
This document is written in plain language. It is intended to reduce misunderstandings and make the ordering process clear. It does not remove or limit any consumer right that applicable law requires Miniekut to provide. Nigerian consumer protection law includes requirements concerning understandable information, price disclosure and consumer rights; Miniekut's policies are therefore to be applied consistently with applicable law.
02 Definitions
03 Who These Terms Apply To
These terms apply to every person or entity purchasing a Miniekut product or service, including bespoke dresses, ready-made dresses, accessories, consultations, express orders and other fashion services offered by Miniekut.
If a client is purchasing on behalf of another person, the purchaser is responsible for ensuring that the wearer receives and complies with the relevant measurement, fitting, delivery and policy requirements.
04 Ordering Process
Clients should review the product description, available options, size information, colour/fabric selections, delivery information and applicable policies before payment.
A typical website order involves: selecting the dress; selecting the size; selecting the colour; selecting any available options; adding the item to cart; reviewing the applicable policies; creating or accessing an account where required; entering accurate delivery and contact information; and completing payment.
For bespoke orders, Miniekut may request additional design information, measurements, consultation details, reference images or other specifications before production can proceed.
An order is not considered ready for production until Miniekut has received the required payment and information necessary to begin the order.
05 Pricing, Quotations & Payment
All prices displayed or quoted by Miniekut are subject to the product or service being purchased and any clearly stated options, upgrades, customisations or additional services.
The client is responsible for paying the amount shown or formally quoted for the selected order, together with any applicable shipping, express, alteration or other charges communicated before the relevant service is provided.
Where a quotation is provided for a custom design, the quoted price may depend on the final design, fabric, embellishment, complexity, quantity and specifications agreed with the client.
Miniekut may require full payment or an approved deposit/payment schedule before production begins.
06 Installment Payments
Installment payments are available for eligible orders of $1,000 and above. Where approved, a client may split the payment into two or three payments according to the payment schedule communicated by Miniekut.
For installment orders, production begins after the second payment. If an order is paid in full from the outset, Miniekut may commence production once the order has been confirmed and all required information has been received.
Failure to make a scheduled installment on time may delay production and/or delivery. Miniekut may pause the order until the outstanding amount is received.
07 Consultation Fees
Where a consultation is required or selected, the applicable consultation fee must be paid before the consultation is scheduled.
Consultation fees are non-refundable once the consultation has been provided or the service has been commenced. Where Miniekut has expressly stated that a consultation fee is deductible from the final invoice, the fee will be credited against the final balance if the client proceeds with the order.
08 Measurements & Fitting
Virtual measurement sessions are compulsory for applicable bespoke orders because accurate measurements are essential to the construction and fitting process.
Clients must provide truthful and accurate information. Measurements should be taken using a soft measuring tape while wearing suitable fitted clothing or undergarments, standing naturally and without pulling the tape excessively tight.
Miniekut may take or request a second set of measurements before shipping. This allows the team to identify significant changes, including weight fluctuations, and make reasonable alterations before dispatch where applicable.
A client who supplies inaccurate, incomplete or outdated measurements accepts that the resulting fit may be affected. Miniekut may offer an alteration solution where reasonably possible, but additional alteration costs may apply where the issue is attributable to the client's measurements or subsequent body changes.
Clients should not select a size solely because it is their usual size with another brand. Miniekut's size chart and measurement instructions should be followed.
09 Body Changes & Fit
Body measurements can change between the time an order is placed and the time a dress is shipped. Miniekut may perform a second measurement check before shipping for applicable orders.
Where an alteration is required because the client's measurements have changed after the original measurements were supplied, the client may be responsible for the applicable alteration cost.
Where an alteration or repair is required because Miniekut made a confirmed production error, Miniekut will be responsible for the reasonable alteration or repair cost associated with correcting that error.
10 Custom Design & Fabric Changes
Miniekut allows customisation where a product or order option expressly permits it. Depending on the design, clients may request changes to colour, fabric, embellishment, styling or other design elements.
For a fabric change, the client should select the applicable Colour Change or customisation option on the website and leave a clear note at checkout describing the requested fabric change.
A requested change does not automatically mean that the original price, production time or design construction will remain unchanged. Miniekut may contact the client where a requested change affects price, availability, feasibility or production timing.
Once production has progressed, design changes may no longer be possible. If a change can still be accommodated, additional costs and/or a revised delivery date may apply.
11 Production Timeline
Standard production generally takes approximately 2–4 weeks, depending on the garment's complexity, embellishment, fabric availability, design requirements, order volume and the time required for fittings or alterations.
Production time and shipping time are separate. A stated production timeline does not include international transit, customs clearance or delays caused by third parties.
Clients ordering for a specific event must provide sufficient time for production, fitting, shipping and unforeseen delays. Miniekut is not responsible for a client's failure to allow reasonable time for these stages.
12 Express / Emergency Orders
Express or Emergency Orders may be requested through the dedicated Express/Emergency Order option on the website, subject to Miniekut's capacity and approval.
An express fee of $200 is required to secure an express booking. The $200 express fee is deductible from the client's final dress balance; it is not an additional dress charge when the order proceeds.
An express request does not guarantee a specific delivery date unless Miniekut has expressly confirmed that date in writing. Courier and customs delays remain outside Miniekut's control.
13 Order Cancellation
Orders cannot be cancelled once production has started.
For installment orders, production starts immediately after the second payment is received. For orders paid in full, production may begin once the order is confirmed and the required information has been received.
If a client requests cancellation before production has started, Miniekut may issue a partial refund at its discretion, after deducting applicable consultation fees, materials already purchased or committed, processing costs and other non-recoverable costs associated with the order.
Once production has started, cancellation will not be accepted and the client remains responsible for the agreed order balance, subject to any rights that cannot lawfully be excluded.
14 Refunds & Returns — Custom Orders
Miniekut's current brand policy allows refunds and returns on custom-made products, including dresses made to a client's measurements, specific colour requests or approved design modifications, subject to the conditions in this Agreement and applicable law.
A refund or return is not automatic merely because a client changes their mind after production. The client should contact Miniekut promptly so that the circumstances can be assessed.
Where a refund is approved, Miniekut will communicate the applicable refund amount and processing timeline. Any refund timing may also depend on the payment provider or financial institution used for the original payment.
15 Ready-Made / Premade Dresses
Where ready-made dresses are offered, refunds or returns may be requested within 3 calendar days of delivery, subject to eligibility.
The returned dress must be unwashed, unworn, undamaged and in its original condition, with all applicable tags, packaging or accessories retained where reasonably required.
Clients are responsible for return shipping costs unless applicable law or an approved Miniekut resolution requires otherwise.
16 Damaged or Incorrect Orders
If a client receives a damaged, defective or materially incorrect dress, the client must notify Miniekut within 48 hours of delivery and provide clear photographs and video evidence showing the issue.
Miniekut will assess the complaint and may, where appropriate, offer a repair, replacement, exchange or refund. The appropriate remedy will depend on the nature and extent of the issue and applicable law.
Where Miniekut confirms that the issue resulted from an error attributable to Miniekut, Miniekut will be responsible for reasonable return shipping and reasonable repair/alteration costs required to correct the confirmed issue.
Issues caused by client-provided measurements, client-requested modifications, normal wear, misuse, accidental damage, improper care or changes in body measurements may not qualify as a Miniekut production error.
17 Refund Processing
Where a refund is approved, Miniekut will process the approved amount within the timeframe communicated to the client. Unless a different timeframe is expressly stated, approved refunds are generally processed within 7–14 business days after approval and receipt of all required information.
The actual time for funds to appear in a client's account may vary depending on the payment processor, bank or financial institution.
18 Shipping & Delivery
Miniekut ships domestically and internationally. Available shipping methods, prices and estimated delivery times depend on the destination and the courier option selected or arranged for the order.
Once an order is dispatched, tracking information will be provided where available. Clients are responsible for monitoring their shipment and ensuring that the delivery address and contact details supplied to Miniekut are accurate.
Miniekut tracks shipments and will assist the client in resolving courier issues where possible. Loss or damage caused by a shipping carrier will be handled through the relevant courier's claims or resolution process, with Miniekut providing reasonable assistance.
19 Customs Duties, Import Taxes & Clearance
International clients may be required to pay customs duties, import taxes, brokerage fees, clearance charges or other destination-country charges. These costs are generally the client's responsibility unless Miniekut expressly states otherwise.
Customs authorities determine whether charges apply and how much is payable. Miniekut does not control the destination country's customs process.
A package delayed because of customs inspection, unpaid import charges, incorrect recipient information or other customs-related issues is not treated as a Miniekut production delay.
20 Failed Delivery & Incorrect Address
Clients must provide a complete and accurate delivery address, telephone number, email address and any other information required by the courier.
Additional shipping costs caused by an incorrect address, refusal to accept delivery, failure to collect a package, repeated delivery attempts or a client-requested change of address may be charged to the client.
21 Client Communication & Responsiveness
Clients are expected to respond promptly to Miniekut's requests for measurements, approvals, payment, design clarification, shipping information or other information needed to complete the order.
Where a client's delayed response prevents production or dispatch from proceeding, the production or delivery timeline may be extended accordingly.
22 Product Care & Client Responsibility After Delivery
Clients should follow garment-care instructions appropriate to the fabric, embellishment and construction of the dress. Damage caused by improper washing, dry cleaning, ironing, storage, alterations by third parties, misuse or accidental damage may not qualify for repair, replacement or refund under Miniekut's policy.
23 Design, Images & Intellectual Property
Miniekut's original designs, sketches, photographs, website content, logos, branding, graphics, product descriptions and other creative materials remain the property of Miniekut or their respective rights holders unless otherwise agreed.
Clients may not reproduce, manufacture, commercially exploit, sell, copy or distribute Miniekut's original designs or creative materials without written permission.
Miniekut may photograph or record completed garments for quality control, portfolio, website, social media or marketing purposes. Where identifiable client images are intended for public marketing use, Miniekut should obtain the appropriate permission or rely on another lawful basis where required.
24 Personal Information & Measurements
Miniekut may collect information required to process orders and provide services, including names, contact information, delivery details, measurements, order information and payment-related information handled through payment providers.
Miniekut should use such information only for legitimate business purposes such as order fulfilment, customer support, delivery, payment processing, service improvement, record keeping and compliance with applicable law.
Personal data should be handled in accordance with applicable Nigerian data protection requirements. The Nigeria Data Protection Commission identifies principles including lawful, fair and transparent processing, purpose limitation, data minimisation, accuracy, storage limitation and appropriate security.
Clients should review Miniekut's separate Privacy Policy for fuller information about data collection, cookies, retention, rights and contact procedures.
25 Events Outside Miniekut's Reasonable Control
Miniekut will make reasonable efforts to fulfil orders, but may be affected by circumstances outside its reasonable control, including courier disruption, customs delays, natural disasters, fire, flooding, power or network interruptions, strikes, government restrictions, supplier shortages, civil unrest, serious operational disruption or other force majeure events.
Where such an event occurs, Miniekut will communicate material delays where reasonably possible and will take reasonable steps to resume performance.
26 Policy Changes
Miniekut may update its policies from time to time to reflect changes in its operations, products, payment methods, shipping arrangements or applicable law. The policy version applicable to an order should be the version communicated or accepted at the time the order is placed, unless a later change is required by law or expressly agreed.
27 Governing Law & Dispute Resolution
These terms are intended to be governed by the laws applicable in Nigeria, subject to any mandatory consumer protection rules that apply to the client or transaction.
If a dispute arises, the client should first contact Miniekut so that the matter can be reviewed and resolved in good faith. Nothing in this Agreement prevents a consumer from exercising a right or remedy available under applicable law or from approaching a competent regulatory or dispute-resolution body.
The Federal Competition and Consumer Protection Commission (FCCPC) is Nigeria's principal consumer protection authority and provides consumer complaint mechanisms.
28 Severability
If any provision of these terms is found to be invalid, unlawful or unenforceable, that provision should be limited or removed only to the extent necessary, while the remaining provisions continue to apply.
29 No Waiver of Mandatory Rights
Nothing in these Terms & Conditions or Brand Policy Agreement is intended to exclude, restrict or waive a consumer right that cannot legally be excluded or restricted. Where a mandatory law gives a client a right that conflicts with a provision of this Agreement, the mandatory legal requirement will prevail to the extent of the conflict.
30 Entire Agreement
These Terms & Conditions, the applicable order confirmation, invoice, approved quotation, product information and any expressly incorporated Miniekut policy form the agreement governing the relevant transaction. If there is a specific written variation agreed by Miniekut for an individual order, that variation will apply to that order to the extent it does not conflict with mandatory law.
